By accessing and using Cartally’s services at cartally.me (“the Service”), provided by Cartally (“Cartally”, “we”, “us”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
2. Changes to Terms
Cartally reserves the right to modify these Terms and Conditions at any time. Continued use of the Service after changes are posted constitutes acceptance of those changes.
3. Registration and Account Security
To use the Service, users must register for an account. Users agree to provide accurate, current, and complete information during the registration process and to update such information as needed.
4. User Conduct
Users agree not to use the Service to:
Violate any laws or regulations.
Infringe upon the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.
5. Acceptable Use Policy (AUP)
Ethical and Responsible Use
Users of Cartally must adhere to our Acceptable Use Policy (AUP). Cartally does not permit users to create chatbots; it solely provides functionalities based on analytical tools and services.
API Providers and Foundational AI Models
Cartally’s services may be supported by foundational AI models provided by third-party partners. Users must:
Refrain from using AI models to generate misleading, harmful, or deceptive content.
Not use AI models to promote hate, discrimination, or violence.
Respect any additional terms, guidelines, and policies set forth by our API providers.
Ensure that any data used does not violate privacy laws, intellectual property rights, or other legal standards.
Violations and Mitigations
User Notifications: Users found in violation of the AUP will be notified and given a chance to rectify the issue or appeal if necessary.
Suspension & Termination: Depending on the severity of the violation, corrective actions may range from temporary suspension to permanent termination of the user’s Cartally account.
Community Feedback: Users are encouraged to report questionable activities or violations.
Policy Review: Our AUP is subject to periodic updates based on evolving industry standards and user feedback.
By using Cartally, you acknowledge that you have read, understood, and agreed to adhere to our AUP. Failure to comply may result in corrective action.
6. Data Protection and Privacy
1. GDPR Compliance (for users in the EU and EEA):
You have the right to request access to, correction of, or deletion of your personal data.
You can object to the processing of your data or request portability.
If your data was collected with consent, you may withdraw consent at any time.
You may file a complaint with a data protection authority regarding our handling of your personal data.
2. CCPA Compliance (for residents of California, USA):
You have the right to know what personal data is collected and shared.
You can request deletion of your personal data, with some exceptions.
Exercising your privacy rights will not affect service pricing or availability.
For both GDPR and CCPA compliance, we commit to resolving privacy-related complaints and do not sell personal data to third parties.
7. Data Storage and Analysis
Cartally may store and analyze data related to applications created through the Service. Data analysis is conducted to improve the Service and is not used for independent commercial purposes.
8. Intellectual Property
Users retain ownership of the intellectual content they create using Cartally. However, by using the Service, users grant Cartally a non-exclusive, transferable, sub-licensable, royalty-free, global license to use, store, display, reproduce, modify, create derivative works, and distribute user content solely for the purpose of operating and improving the Service.

10. Limitation of Liability
To the maximum extent permitted by law, Cartally shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill resulting from:
Your access to or use of (or inability to access or use) the Service.
Unauthorized access, use, or alteration of your transmissions or content.
Any other matters related to the Service.
11. Termination
Cartally reserves the right to terminate or suspend your account at its discretion, without notice, if it determines that your conduct violates these Terms, harms other users, third parties, or negatively affects Cartally’s business or reputation.
12. Governing Law
These Terms and Conditions and any dispute or claim arising from them shall be governed by and construed in accordance with the laws of Poland.
